Terms and Conditions
Eligibility
- This Connect2Home Smart Home pilot (the “Pilot”) is being offered by PECO Energy Company (“PECO”) and is open to PECO’s (1) residential customers in single family homes with individual meters, (2) residential customers in single family homes with individual meters currently receiving Home Energy Reports (“HERs”), and (3) residential customers in pre-selected multi-family buildings that are individually metered.
- Residential customers in single family homes with individual meters and residential customers in single family homes with individual meters and receiving HERs are required to have a compatible smart thermostat. A list of compatible smart thermostats is available at https://pecoconnect2home.com/compatible-devices/.
- Certain customers selected by PECO or a Pilot administrator acting on PECO’s behalf (the “Pilot Administrator”) will receive a smart thermostat (if needed), smart lights, and smart plugs (the “Smart Devices”).
- All participants must have access to Wi-Fi at the residence where the technology listed above will be used or installed, and a smart phone.
The Pilot is limited, and participants will be selected on a first-come, first-served basis.
No Cost Technology, Installation and Support:
- Participants may keep any technology provided to them by the Pilot, including any Smart Devices, and the PECO Connect2Home app (together with the Smart Devices, the “Pilot Technology”), after the completion of the Pilot; however, support for the Pilot Technology may no longer continue. Customers will receive options for continued support at the completion of the Pilot. PECO is not responsible for any hardware, devices, or technology, the impacts of the Pilot Technology, or in-person support of the Pilot Technology after Pilot completion. Neither PECO, nor anyone acting on PECO’s behalf will remove technology that has been provided to Customers.
Voluntary Pilot
- The Pilot is entirely voluntary. Customers who sign up to participate understand that, prior to and during the period they will be using the connected technologies, their data use will be analyzed by PECO, the Pilot Administrator and/or any other consultant engaged by PECO for this purpose.
- By participating in the Pilot, customers agree to allow PECO, the Program Administrator or other third-party contractor or consultant to control the Smart Devices (and, if a customer already had a compatible smart thermostat, the customer’s smart thermostat) during Energy Saving Hours, if they are enrolled in “Automatic” mode. Energy Saving Hours are hours that coincide with high demand for electricity, typically during cold winter weekdays when many people run their heating units and other devices at the same time.
- PECO is exploring ways to curb demand during these peak periods and is offering the Connect2Home app and additional incentives to help customers participate in energy savings during these times.
- Energy Saving Hours will take place daily for two 10-day periods – one in January and one in February 2026, Monday-Friday only. Each event may last up to four hours. For further details, see the FAQs: https://pecoconnect2home.com/about-the-pilot/.
- Customers may choose to exit the PECO Connect2Home Pilot at any time. Smart Devices can be removed from the Connect2Home app and Pilot at the customer’s convenience.
Gift Card
- All customers who enroll in the Pilot and successfully connect at least one device will receive a $20 gift card. Participants can earn an additional $100 in gift cards by participating in Energy Saving Hours. The additional $100 will be credited in $5 increments for participation in each daily event over the course of both 10-day periods in January and February.
CUSTOMER AGREEMENT
- By submitting your application to the Pilot, and by your participation in the Pilot, you (“Customer”) agree to the terms and conditions above and in this Customer Agreement (together, this “Agreement”). Capitalized terms used in this Customer Agreement without definition will have the meanings ascribed to them above.
- PECO may assign or delegate any of its rights or obligations under this Agreement to independent contractors, consultants, or other third-party organizations. Customer’s rights may not be assigned or transferred without PECO’s written consent.
- The Pilot is being administered on PECO’s behalf by a third-party Program Administrator. More information about the Program Administrator is available in the Frequently Asked Questions for the Pilot.
- Customer consents to the collection and use by PECO, the Program Administrator or other third-party contractors or consultant engaged by PECO for the Pilot, of information from the Smart Devices (and, if Customer already had a compatible smart thermostat, Customer’s smart thermostat), including about Customer’s energy usage, associated account, billing data, and smart thermostat data to evaluate and improve its demand response and energy efficiency programs, and make specific recommendations for decreasing your overall energy usage. Such information includes, but is not limited to, consumption and billing data, meter usage data, rate information, and heating/cooling run times.
- None of PECO, its affiliates, or their respective officers, agents, employees, contractors, or representatives, including the Pilot Administrator (the “PECO Parties”) will be liable to Customer or to any third party for any losses or damages, including loss of profits, loss of earnings, loss of business opportunities, and personal injuries (including death), including, without limitation, any damage resulting from or arising out of Customer’s participation in the Pilot.
- Customer understands that none of the PECO Parties assumes any responsibility for, nor shall they have any responsibility for the condition or repair of, Customer’s heating system or other equipment. Customer understands that Customer is responsible for the repair and maintenance of Customer’s equipment.
- THE PILOT AND EQUIPMENT ARE PROVIDED BY PECO “AS IS.” CUSTOMER UNDERSTANDS AND ACKNOWLEDGES THAT NONE OF THE PECO PARTIES MAKES ANY REPRESENTATIONS OR WARRANTIES ABOUT THE PILOT TECHNOLOGY OR THE PILOT, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ALL WARRANTIES ARE DISCLAIMED BY THE PECO PARTIES TO THE FULLEST EXTENT PERMITTED BY THE LAW. SMART DEVICE WARRANTIES ARE LIMITED TO THOSE, IF ANY, PROVIDED BY THE MANUFACTURER.
- Customer agrees to hold harmless, defend, and indemnify the PECO Parties from and against any third-party claim arising from or in any way related to Customer’s improper use, or the improper use by any person on Customer’s premises, of the Smart Devices or the Pilot, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorneys’ fees, of every kind and nature. If any such claim, suit, or action should arise, PECO will provide Customer with written notice thereof.
- This Agreement constitutes the entire agreement between Customer and PECO. No undertaking, representation, or warranty made by any agent or representative of PECO in connection with the sale, installation, maintenance, or removal of PECO’s services or Smart Devices shall be binding on PECO except as expressly included herein.
- Customer understands that PECO reserves the right to modify the terms of the Pilot. Customer will receive notice of any such Pilot modification. Customers’ continued participation in the Pilot following notice of such change shall be considered acceptance of such modification.
- The above provisions regarding warranties, disclaimers of warranty and liability, and termination will survive the termination of this Agreement. Failure to insist on strict performance of any of the terms and conditions of this Agreement will not operate as a waiver of any subsequent default or failure of performance. If any part of the above is determined to be invalid or unenforceable by a court of competent jurisdiction, then the invalid or unenforceable provision will be deemed ineffective and the remainder of the Agreement shall continue in effect. No joint venture, partnership, employment, or agency relationship exists between Customer and PECO as a result of this Agreement.
